Wendell Smallwood Jr. is getting a chance to be with his daughter in her final days after a Gloucester County Superior Judge approved a motion that opens the door for his early release from prison.
The former Eagles and Steelers running back had his guilty plea withdrawn by Judge Renard Scott, according to The News Journal, after an emergency hearing on Aug. 7 found that his daughter’s condition was a significant reason to grant the request.
Smallwood’s 8-year-old daughter, Mila, was diagnosed in 2026 with diffuse anaplastic Wilms tumor, an aggressive and rare childhood kidney cancer, the report said. She is now in palliative care and has been given just days or weeks to live after chemotherapy did not work.
Smallwood had been sentenced last September to 18 months in prison in connection with a COVID-related fraud scheme. He pleaded guilty in December 2024 to felony wire fraud, conspiracy and tax fraud tied to economic relief programs.
He also pleaded guilty to second-degree unlawful possession of an assault firearm after being found with an AR-15 rifle in New Jersey, and he received a three-year prison sentence on that charge.
A July ruling from the 3rd Circuit Court of Appeals changed the legal landscape in his case, with the court determining that New Jersey’s ban on assault weapons was unconstitutional. That ruling gave Smallwood the grounds to seek withdrawal of his plea.
Smallwood, 32, was a standout at West Virginia before the Eagles took him with the No. 153 pick in the fifth round of the 2016 NFL draft.
He rushed for 850 yards and five touchdowns over three seasons with Philadelphia from 2016 through 2018 and was part of the Super Bowl LII championship team.
After that, Smallwood spent the 2019, 2020 and 2021 seasons moving between the Commanders, Steelers, Jaguars and Commanders again. He played in one game for Pittsburgh in 2020 and spent most of that season on the practice squad.
