The situation gained attention as Kingston's defense attorney, Cara Tangaro, argues that the alleged victim's account seems to mirror details from a previous case involving Kingston’s former teammate, Jake Retzlaff. According to court documents, Kingston and the alleged victim, identified as A.M., connected on social media in early 2025. The charges were formally brought against Kingston in February 2026. Tangaro’s court filing highlights a timeline that suggests A.M. decided to pursue charges shortly after a news report on the Retzlaff case was published.

Kingston was initially arrested and held in jail but was later released on bail with the condition of wearing a GPS ankle monitor. Tangaro is pushing for the removal of this monitor, arguing that Kingston has fully cooperated with the investigation.

The incident in question reportedly took place in February 2025 at A.M.'s apartment in St. George.

A.M. reported the alleged assault several days later at a local hospital. Detective Cody Layton’s statement indicates that after consensual activity, A.M. claimed Kingston attempted to initiate further activity against her will.

Kingston maintains that all interactions were consensual and has cooperated with police interviews. Text messages retrieved from Kingston’s phone play a significant role in the prosecution’s case, suggesting his intention to engage in sexual activity during his visit to A.M.'s residence.

The defense contends that A.M. reached out to Kingston in March 2025, expressing that she felt taken advantage of. Kingston responded, apologizing and asserting that he believed their interactions were consensual.
